Frequently Asked Questions

Finding the right Adelaide lawyer to resolve your legal matters can be difficult. But at YLP Legal – Your Legal Partner, we want to make it simpler by answering some of your wills, estate planning, and estate administration questions.

Dying without a valid Will means your estate will be distributed according to the rules of intestacy as outlined in the Administration and Probate Act 1919 (SA). This may not align with your personal wishes. The estate is distributed amongst your relatives in a specific order according to the formula set out in the legislation.

To avoid this, it is crucial to have a valid Will in place at the time of your passing. Consulting with the expert lawyers at YLP Legal can ensure your Will is properly drafted to reflect your wishes, providing peace of mind for you and your loved ones.

Estate Planning involves arranging a person’s affairs to ensure their wishes are fulfilled after death. This includes the creation of Wills, establishing trusts, naming beneficiaries and the creation of healthcare directives and financial Powers of Attorney.

Estate Administration refers to the process after death, involving probate, the distribution of assets according to the Will (or state laws if no Will exists), settling debts, and managing estate affairs.

A General Power of Attorney is suitable for specific transactions or limited periods of time. This Power of Attorney grants the donee authority to manage your financial, legal and contractual affairs  either temporarily or until you revoke the  Power of Attorney or lose capacity.

While an Enduring Power of Attorney can take effect immediately if you should choose so and continues even if you become incapacitated, ensuring ongoing management of your finances.

An Advance Care Directive typically covers several important aspects of your preferences for future care:

  1. Personal Values and Priorities: Your views on what makes life meaningful, including relationships, independence, and religious beliefs.
  2. Undesirable Outcomes: Situations you wish to avoid, such as prolonged life support without recognition of loved ones or being in a coma.
  3. End-of-Life Wishes: Preferences regarding the location of your passing, the presence of certain people, religious practices and organ donation.
  4. Living Arrangements: Your preferences about staying at home or moving into supported care.
  5. Healthcare Preferences: Types of medical and emergency care you wish to receive or avoid, including life-sustaining treatments.
  6. Other Personal Considerations: Cultural, spiritual, lifestyle , and even smaller personal care preferences.

This directive ensures your wishes are respected even when you might not be able to communicate them yourself.
